Terms of Use

These Terms of Use ("Terms") govern your use of cemeteryledger.com and the CemeteryLedger platform (the "Service"), operated by CemeteryLedger ("we," "us"). By using the Service — whether browsing the public record, contributing a photo, or operating a cemetery account — you agree to these Terms.

1. The Service

CemeteryLedger has two parts: a free, public, crowdsourced grave locator (the "Public Ledger"), and a private operations platform for cemetery, crematory, and memorial-ground organizations (the "Operations Platform"). Different rules apply to data in each part, as described below.

2. Public contributions

Anyone may submit headstone photos, locations, transcriptions, and memorial notes to the Public Ledger, with or without an account. By submitting, you represent that you took the photo or otherwise have the right to submit the material, and that it was captured in a place open to you.

Ownership and license. Public contributions are made for the purpose of permanent publication. Upon submission, you assign to CemeteryLedger all right, title, and interest in the submitted material, and it becomes part of the Public Ledger owned and maintained by CemeteryLedger. Where such an assignment is not permitted by law, you instead grant CemeteryLedger a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to host, publish, reproduce, adapt, and distribute the material as part of the public record. You will not be paid for contributions; you contribute to help preserve history.

Permanence. The Public Ledger is designed as a permanent archive. Accepted contributions are intended to remain published indefinitely and will not routinely be removed at a contributor's request. We review removal requests for content that is inaccurate, unlawful, harmful, or subject to a legitimate family privacy concern (see our Privacy Policy).

Moderation. Submissions are screened by automated systems and may be reviewed by human moderators or by the staff of a claimed cemetery. We may accept, reject, edit, annotate, merge, or reposition submissions to maintain the accuracy of the record.

3. Cemetery operations data

Data entered by a cemetery organization into the Operations Platform — burial and interment registers, plot and niche inventory, interment rights, work orders, grave file documents, staff records, and related business records ("Cemetery Data") — is private and remains the property of that organization. CemeteryLedger acts as custodian of Cemetery Data and acquires no ownership of it. We will not sell Cemetery Data, share it with other organizations, or publish it, except for records the organization itself confirms to its public profile.

Permanent record keeping. Cemetery organizations use CemeteryLedger to maintain records that carry perpetual retention obligations. We commit to: durable, redundantly backed-up storage of official records; an append-only audit trail of changes to official records; export of Cemetery Data on demand; and retention of official records even if a subscription lapses. Suspension or cancellation of a paid plan limits access to paid features — it does not delete a cemetery's records, and records already confirmed to the Public Ledger remain publicly findable. If an organization requests permanent deletion of its Cemetery Data, we will honor the request except where retention is required by law, and public-record entries derived from public contributions will remain part of the Public Ledger.

Responsibility. The organization is responsible for the accuracy and lawfulness of the Cemetery Data it enters, for maintaining its own statutory record copies where required, and for the actions of the staff accounts it authorizes.

4. Accounts

You must provide accurate information when creating an account and keep your credentials confidential. Cemetery claims are verified before an organization is granted control of a cemetery profile; submitting a fraudulent claim is grounds for immediate termination. We may suspend accounts that violate these Terms or threaten the integrity of the record.

5. Subscriptions and billing

Paid plans are billed by subscription through Stripe. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice; changes apply at the next renewal. As stated above, non-payment restricts access to paid features but does not forfeit an organization's records.

The Service, its software, design, and the compiled Public Ledger are the property of CemeteryLedger. These Terms do not transfer any CemeteryLedger intellectual property to you, and do not transfer any ownership of Cemetery Data to us.

8. Disclaimers

The Public Ledger is a crowdsourced historical record provided "as is." While we moderate and verify what we can, we do not warrant the accuracy or completeness of any record. The Service is not a substitute for a cemetery's statutory registers where the law requires an original register to be maintained in a particular form.

9. Limitation of liability

To the maximum extent permitted by law, CemeteryLedger will not be liable for indirect, incidental, special, or consequential damages, or for loss of profits or data, arising from use of the Service. Our aggregate liability for any claim is limited to the amounts paid by you to CemeteryLedger in the twelve months preceding the claim.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by a new effective date on this page and, for account holders, notice by email. Continued use of the Service after changes take effect constitutes acceptance.
